Options For Buying Land And House In Thailand For Foreigner
In general, foreigner is unable to own land in Thailand except for the foreigner who obtained permission from minister of interior with having some conditions as identified by law. However foreigner is able to own the house (s) or any structures built/to be built upon the land by their own name as separate ownership between land and house.
Here are the options for foreigner to own land:
Option 1: setting up a Thai limited company to buy the land from the seller. The Thai limited company may having foreign shareholder holding shares not more than 49% and/or director(s).
Option 2: lease the land from the seller, foreigner must enter into a land lease contract with the seller for a term of not more than 30 years and bring the contract registered at the land office.
Option 3: registering a superficies with the seller, superficies is the real right creating by a contract and must be registered at the land office, you may agree with the seller creating the superficies for a term of not more than 30 years or for your lifetime.
